Terms of Service

These Terms of Service ("Terms") govern your use of JunkQuote, a mobile application and related website operated by TUCKR89 LLC ("TUCKR89," "we," "us," or "our"). By using JunkQuote, you agree to these Terms.

1. Purpose of JunkQuote

JunkQuote is a business planning utility for estimating junk-removal job costs, generating pricing guidance, comparing customer offers, recording actual job results, and reviewing locally generated insights. It is not an accounting, tax, legal, safety, disposal-compliance, or financial advisory service.

2. Estimates and user responsibility

All quotes, margins, profit figures, pricing-health indicators, historical comparisons, and similar-job guidance are estimates based on information entered by you and calculations performed by the app. Actual labor time, disposal charges, material weight, site access, fuel/vehicle costs, taxes, fees, local regulations, customer circumstances, and other conditions may differ. You are solely responsible for inspecting the job, confirming applicable costs and legal requirements, and deciding the final customer price.

3. No guarantee of profit

JunkQuote does not guarantee that a recommended price will be accepted, profitable, lawful, competitive, or appropriate for a particular job. Historical performance does not guarantee future results.

4. Eligibility

You must be legally capable of entering into a binding agreement. If you use JunkQuote on behalf of a business or other organization, you represent that you have authority to do so.

5. Local data

JunkQuote V1 stores business settings, quote data, job history, pricing tools, and related app preferences locally on the device. V1 does not provide a JunkQuote account or cloud synchronization. You are responsible for maintaining access to your device and any records you need for business, tax, legal, or accounting purposes.

6. Free and Pro features

JunkQuote may offer a Free tier with usage limits and a JunkQuote Pro subscription that removes certain app-imposed limits and unlocks additional pricing and historical tools. Current feature availability is shown in the app and may evolve over time. We will not intentionally misrepresent unavailable features as active.

7. Subscriptions and automatic renewal

JunkQuote Pro may be offered as an auto-renewing subscription through the applicable app store. Before purchase, the store displays the current localized price, billing period, and any material offer terms. Unless canceled, an auto-renewing subscription renews according to those displayed terms.

8. Billing, cancellation, and refunds

App-store subscriptions are billed by the store used for the purchase. You can manage or cancel a Google Play subscription through Google Play's subscription-management tools. Cancellation generally prevents future renewal while access may continue through the paid period, subject to store rules and applicable law. Refund eligibility is governed by the applicable store's policies and applicable law.

9. Restoring purchases and entitlement

Where supported, JunkQuote provides a restore function that asks the app store to report qualifying purchases for the account in use. Store-reported purchase state controls release entitlement when available. Temporary offline access may rely on a limited last-known verification cache and is not a substitute for store verification.

10. Acceptable use

You may not use JunkQuote to violate law, facilitate fraud, interfere with the app or its store integrations, bypass subscription controls, reverse engineer protected components except where applicable law expressly permits it, or misuse TUCKR89 trademarks or copyrighted materials.

11. Intellectual property

JunkQuote, its software, branding, website, documentation, and original content are owned by or licensed to TUCKR89 and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.

12. App stores

If you download or purchase JunkQuote through Google Play or another app store, you also agree to that store's applicable terms. The store may process payments, subscriptions, refunds, and account information independently of TUCKR89. To the extent of a conflict involving store billing or platform rules, applicable store terms and mandatory law may control that part of the transaction.

13. Changes to JunkQuote

We may improve, add, remove, or modify features, limits, supported platforms, and Pro benefits as the product evolves. Material subscription changes will be handled in accordance with applicable law and store requirements.

14. Availability

We do not guarantee uninterrupted or error-free operation. Device failures, operating-system changes, store outages, network problems, software defects, or events outside our reasonable control can affect use.

15. Disclaimer of warranties

To the maximum extent permitted by law, JunkQuote is provided on an "as is" and "as available" basis. We disclaim warranties that are not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent legally permitted. Nothing in these Terms limits rights that cannot legally be waived.

16. Limitation of liability

To the maximum extent permitted by law, TUCKR89 will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, lost opportunities, lost data, underquoted jobs, disposal-cost differences, or customer disputes arising from or related to use of JunkQuote. Any limitation applies only to the extent permitted by applicable law.

17. Indemnification

Where legally permitted, you agree to indemnify and hold TUCKR89 harmless from third-party claims arising from your unlawful use of JunkQuote, your business operations, or your material violation of these Terms.

18. Consumer rights

These Terms do not exclude or limit mandatory consumer rights that cannot lawfully be waived in your jurisdiction.

19. Changes to these Terms

We may update these Terms as JunkQuote changes. We will update the Last Updated date and provide additional notice where required by law.
